Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the website at junkremovaldurham.ca or booking services from Durham Junk Removal (“we,” “us,” or “our”). By using our website or booking our services, you agree to be bound by these Terms.

1. Services

Durham Junk Removal provides residential and commercial junk removal, estate cleanout, appliance removal, construction debris removal, and related services in Durham Region, Ontario.

All services are subject to availability. We reserve the right to decline any job at our discretion, including jobs that are unsafe, involve hazardous materials, or fall outside our service area.

2. Quotes and Pricing

• All quotes are provided free of charge and are non-binding until confirmed in writing or verbally on the day of service.
• Final pricing is based on the actual volume of material removed and the labour required. We will always inform you of the final price before beginning work.
• Prices may be adjusted if the scope of the job is materially different from what was described at the time of quoting (e.g., significantly more items than quoted, access difficulties not disclosed, hazardous materials).
• All prices are in Canadian dollars and include applicable taxes unless otherwise stated.

3. Booking and Confirmation

Submitting a quote request on our website does not constitute a confirmed booking. A booking is confirmed when we contact you (by phone, SMS, or email) and agree on a date, time, and price.

For same-day bookings, we will confirm availability at the time of your call or within 30 minutes of your online request.

4. Cancellation Policy

• More than 4 hours before scheduled pickup: Cancel at no charge.
• Less than 4 hours before: A cancellation fee of up to $50 may apply to cover crew scheduling costs.
• No-show (crew arrives, no access): A trip fee of up to $75 may apply.

5. Payment

• The balance owing for service is due upon completion unless a deposit has been collected in advance.
• We accept cash, e-transfer (Interac), major credit/debit cards, and secure online payment links sent via SMS or email (processed by Stripe).
• A non-refundable booking deposit (typically $50) may be collected online via a secure Stripe payment link after your booking is confirmed. The deposit is applied to your total — you pay only the remaining balance after the job is done.
• If you cancel with less than 4 hours' notice after paying a deposit, the deposit may be forfeited as a cancellation fee (see Section 4).

We do not store credit card information on our servers. All online card payments are processed securely by Stripe. See our Privacy Policy for details on how payment data is handled.

6. Hazardous and Prohibited Materials

We do not remove the following items:

• Asbestos or materials containing asbestos
• Biological or medical waste
• Flammable or explosive materials
• Chemicals, solvents, or pesticides (in large quantities)
• Radioactive materials

If hazardous materials are discovered on arrival that were not disclosed, we reserve the right to cancel or adjust the scope of service. A trip fee may apply.

7. Property and Liability

Our crew takes care to protect your property during the removal process. However, Durham Junk Removal is not liable for:

• Pre-existing damage to property
• Damage resulting from accessing items in unusually tight or difficult spaces not disclosed in advance
• Items accidentally included in the removal that you wish to keep — please ensure all items to be kept are clearly set aside before the crew arrives

Our maximum liability for any property damage caused by our crew during a job is limited to the greater of the amount paid for that job or $100 CAD, except in cases of gross negligence. We recommend you document and set aside any items you wish to keep before our arrival.

8. Disposal and Recycling

We make reasonable efforts to donate, recycle, or otherwise divert materials from landfill. However, we cannot guarantee the final disposition of any specific item. By engaging our services, you relinquish ownership of all removed items and authorize us to dispose of them as we see fit, including donation, resale, recycling, or landfill disposal, in compliance with Ontario environmental regulations.

9. Website Use

By using our website, you agree to:

• Provide accurate and truthful information in quote requests
• Not attempt to interfere with the operation of our website
• Not use our website for any unlawful purpose

We reserve the right to block access to users who misuse the website or submit fraudulent requests.

10. Limitation of Liability

To the maximum extent permitted by Ontario law, Durham Junk Removal is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.

Our total liability to you for any claim arising from a specific service job shall not exceed the greater of (a) the total amount you paid for that job or (b) $100 CAD. This limitation does not apply to claims arising from our gross negligence or wilful misconduct.

11. Disclaimer of Warranties

Our website is provided “as is” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Force Majeure

Durham Junk Removal is not liable for delays or failure to perform services resulting from circumstances beyond our reasonable control, including but not limited to severe weather, road closures, equipment failure, or other unforeseeable events. We will make reasonable efforts to reschedule affected bookings promptly at no charge.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. We will post the revised Terms on this page with an updated effective date.
